Terms and Conditions

 
1. Payment of Booking Deposit
Payment of the Booking Deposit in cleared funds constitutes acceptance of the offer to rent the Property on the terms of the Booking Conditions and these terms and conditions. Payment of the Booking Deposit may be made by cash, money order, cheque, credit card or by EFT or direct transfer into the following SCH account:

2. Payment of balance of rental due:
In the event that the balance of the rental payable is not paid within 14 days of the start of the Ocuupation Period or such other extended period as may be agreed in writing, SCH may cancel the booking and terminate this agreement. In those circumstances the Booking Deposit will not be refunded.
3. Cancellation of booking
In the event that the booking is cancelled by the Occupant for any reason after payment of the Booking Deposit, neither the Booking Deposit nor any other amount subsequently paid is refundable unless the Property is subsequently re-let to another occupant for the same period and at the same rental. In the event that the Property is re- let for a shorter period and/or at a lesser rental the Owners may retain the difference which constitutes their loss and SCH will refund the balance. SCH strongly recommends that all occupants take out their own travel insurance. 
4. Assignment and transfer of booking to another property:
The Occupant may only assign the benefit of this agreement to a third party with the consent in writing of SCH. The Occupant may request SCH transfer the booking to another property after payment of the Booking Deposit but SCH is under no obligation to do so.<br>
5. Number of occupants:
Apart from a reasonable number of day visitors on any particular day during the Occupation Period, the number of people occupying the Property must not exceed the number stipulated in the Booking Details. Any breach of this provision will allow SCH to terminate this agreement with immediate effect and will result in the forfeiture of the Security Bond. Occupants are responsible, and liable, for the actions of their guests during the period of their stay in the Property.
6. Security Bond:
The Security Bond which is payable is $1,000.  It may be applied towards the reasonable costs of any repairs that are required to the property as a consequence of the actions of the Occupants or their guests. It may also be applied towards the replacement of breakages or other loss or damage to fittings or furniture during the period of occupancy and towards any other losses sustained by the owners as a direct or indirect consequence of the actions of the Occupants or their guests whether as a consequence of a breach of the provision of this agreement or not. In the event that the costs of repairs or other losses exceed the amount of the security bond, the Occupants will indemnify the Owners for any such losses and will pay same on demand. Where the Occupants have provided their credit card details, by their entry into this agreement the Occupants authorise the Owners to obtain payment for such additional losses (including amounts payable pursuant to cl 7, 8 and/or 9) by way of the Occupant’s credit card using those details as supplied.
7. Other losses:
Lost keys incur a minimum charge of $40. Lost or damaged remote controls to any electronic device will incur a minimum charge of $50.00. No furniture, bedding, furnishings, appliances or electronic devices may be removed from the Property.
8. No smoking:
The smoking of any substance within the premises located on the Property is not permitted. Where additional cleaning is required as a consequence of smoking indoors an excess cleaning fee of up to $100 can be charged.
9. Noise and complaints:
Occupants are expected to respect their neighbours and the local community. In the event that representatives of SCH are required to attend the Property during the Occupation Period as a consequence of noise complaints or complaints as to the Occupant’s behaviour by neighbouring property owners, the sum of $100.00 will be deducted from the Security Bond. A second or subsequent breach may lead to the immediate termination of this agreement and the loss of the Security Bond in full.
10. Breakdowns:
The breakdown of any electrical or other device during the Occupation Period should be reported to SCH as soon as possible and reasonable attempts will be made where practical to repair the item in question. SCH accepts no liability or responsibility for any inconvenience due to the breakdown of any appliance or device supplied in conjunction with the rental of the property during the Occupation Period. Where the Property has a gas barbecue relying on bottled gas it is the Occupants responsibility to refill this if it should run out during the Occupation Period.<br>
11. Use of the property:
The Property is to be used for holiday purposes only and strictly for the period stated in the Booking Conditions. The Property may not be used for functions such as birthdays, bucks parties, weddings or other similar arrangements without the prior written consent of SCH. Deleterious activities which may adversely impact on the Property such as, but not limited to, the cleaning of fish or the opening of shellfish are not to be carried out on the Property during the period of the tenancy. Any damage to the Property during the Occupation Period must be reported to SCH immediately.<
12. Description of the property:
SCH relies on the information provided by the Owners in relation to its advertising of the Property. This information is, however, subject to change and SCH accepts no liability or responsibility for any inaccuracy or misdescription in relation to the Property contained in any promotional or other material placed in the public domain by SCH. SCH recommends that prospective occupants view the Property before paying the Booking Deposit. Any verbal description given of the Property by SCH is given in good faith and SCH is not liable for any misdescription or error in detail so given.
13. Personal property of tenants:
Security of the Property during the Occupation Period is entirely the responsibility of the Occupants. Neither SCH nor the Owners are in any way responsible for any loss or damage to any personal property owned by the Occupants or their guests during the Occupation Period. Any property of the occupants found at the Property which are required to be mailed to the Occupants will incur a $20 handling fee plus packaging and postage charges.
14. No pets
No animals of any kind are permitted on the Property during the Occupation Period.<br>
16. Change of booking by owner:
SCH is not responsible for any actions taken by the Owners of the Property prior to the receipt of the Booking Deposit by SCH which may cause the Property to become unavailable. SCH will attempt locate alternative accommodation in such circumstances where practical.
17. No liability:
SCH accepts no liability for any injury, loss or damage of any kind, howsoever caused, sustained by the Occupants resulting from their use of the Property pursuant to this agreement as a consequence of events or actions that are outside the reasonable control of SCH, including force majeure. Liability for any loss or damage sustained by the Occupants or their guests, including personal injury, is otherwise excluded to the extent permitted by law.
18. No interest in land
Nothing in this agreement shall be construed as creating a tenancy or conferring an interest in land upon the Occupants.

Who We Share Your Information With
South Coast Holidays Pty Ltd does not disclose any information about customer bookings to anyone except in the following circumstances:
• Accommodation suppliers - South Coast Holidays Pty Ltd provides the guest name, telephone number, address and email address for each booking made to the relevant accommodation supplier. Our accommodation suppliers require this information for the booking and if they need to contact you about the booking. Although South Coast  Holidays Pty Ltd offers accommodation from reputable accommodation suppliers, we have not placed specific limitations on these suppliers from using or disclosing your information without your permission. Therefore, we encourage you to review the privacy policies of any suppliers whose accommodation you purchase on Www.southcoastholidays.com.au.
• Legal obligations - South Coast Holidays Pty Ltd may be required by law to disclose information provided by you to South Coast Holidays Pty Ltd for the purposes of obtaining products or services from Www.southcoastholidays.com.au. South Coast Holidays Pty Ltd may also disclose information against someone who poses a threat to South Coast Holidays Pty Ltd interests (such as customer fraud) or whose activities could cause harm to others.

All prices listed on this website are in Australian Dollars (AUD$), please refer to the Currency Converter on the Accommodation search page for the price in you local currency.
